Terms and Conditions of Sale
This English version is provided for convenience. In case of discrepancy, the French version prevails.
Article 1 — Purpose
These terms and conditions of sale ("Terms") govern the sale by Comallagency LLC ("we", "Hermes Agent France"), reachable at contact@hermesagentfrance.com, of the hosted personal AI assistant subscription service ("the Service") to any individual or entity subscribing to a plan ("the Client").
Article 2 — Description of the Service
The Service consists of installing, configuring, and operating, on behalf of the Client, a dedicated instance of the Hermes Agent software, accessible via Telegram and via a dedicated e-mail address provided to the Client, both channels included in every plan.

The prices above are those displayed on the activation page of the client area, which prevails in case of discrepancy. Payment is made by credit card via our provider Stripe, on a recurring monthly basis, with automatic renewal on each subscription anniversary date.
Each plan includes a technical usage cap: the agent's consumption can never exceed the cap associated with the subscribed plan over a given billing period, without any action from the Client. This is a technical cap, not merely a commercial promise.
The prices displayed above and on the activation page are those actually billed to the Client, inclusive of any applicable taxes. No additional amount is added at the time of payment.
Article 4 — Money-Back Guarantee
If the Service doesn't meet your expectations, contact us within 14 days of subscribing — we'll refund you in full, no questions asked.
Article 5 — Term, Renewal, and Cancellation
The subscription is entered into with no minimum term and renews automatically each month, unless cancelled. The Client may cancel at any time from their client account, Billing section, in one click and without justification. Cancellation takes effect at the end of the current billing period and the agent remains active until that date; no pro-rata refund is issued for the period already underway, except where required by law.
Upon cancellation or end of contract, the Client may request the return of their data and their agent's configuration (reversibility), in accordance with the commitment made on our homepage. This request is made via a support ticket or by e-mail to contact@hermesagentfrance.com.
Article 6 — Right of Withdrawal
In accordance with Article L221-18 of the French Consumer Code, consumer Clients generally have a 14-day period to exercise their right of withdrawal from the date of subscription.
However, in accordance with Article L221-28 13° of the French Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of digital content not supplied on a physical medium whose performance has begun after the consumer's prior express agreement and express waiver of their right of withdrawal. This agreement is collected via a dedicated checkbox, separate from acceptance of these Terms, presented on the activation page before any payment. By checking this box, the Client expressly acknowledges and accepts that performance of the Service begins immediately and waives their right of withdrawal once the Service has been fully performed (agent brought online) before the 14-day period expires.
Article 7 — Client Obligations
The Client agrees to provide accurate information when registering and configuring their agent, not to use the Service for unlawful purposes, and not to attempt to circumvent the technical limits of their plan.
Article 8 — Liability
The Service is provided "as is." Hermes Agent France implements reasonable means to ensure the availability and reliability of the Service, without guarantee of results regarding the actions, responses, or content generated by the AI agent, which rely on third-party artificial intelligence models. Hermes Agent France's liability cannot be engaged for any indirect damage resulting from use of the Service.
Article 9 — Personal Data
The processing of the Client's personal data is described in our Privacy Policy.
Article 10 — Intellectual Property
The Client retains ownership of the data and content they provide to their agent. Hermes Agent France retains full rights to its site, brand, and integration know-how.
Article 11 — Changes to the Terms
Hermes Agent France reserves the right to modify these Terms. Any new version will carry a version number and effective date displayed at the top of this page. The Terms applicable to a Client are those whose version they accepted upon registration or, in case of a subsequent substantial change, those notified to them by e-mail.
Article 12 — Applicable Law and Disputes
These Terms are governed by French law. Where the consumer Client resides in another Member State of the European Union, this clause does not deprive them of the mandatory protective provisions of the law of their country of residence.
In the event of a complaint, the Client may write to us at contact@hermesagentfrance.com: we commit to responding within 5 business days and to seeking an amicable solution. Once we join an approved consumer mediation service, the consumer Client will also be able to use it free of charge — that mediator's details will be added here at that time. Failing an amicable solution, the dispute falls under the competent court's jurisdiction.
